In 2002 the Florida legislators passed the Move Over Law Bill. The Bill was passed as a way to protect law enforcement officer(s) and emergency personnel on Florida’s roadways.
Any person who violates the laws is punishable by a fine of upwards of $164.00 and 3-points placed against their Driver License.
When an authorized emergency vehicle making use of any visual signals is parked or a wrecker displaying amber rotating or flashing lights is performing a recovery or loading on the roadside, the driver of every other vehicle, as soon as it is safe:
Shall vacate the lane closest to the emergency vehicle or wrecker when driving on an interstate highway or other highway with two or more lanes traveling in the direction of the emergency vehicle or wrecker, except when otherwise directed by a law enforcement officer.
Shall slow to a speed that is 20 miles per hour less than the posted speed limit when the posted speed limit is 25 miles per hour or greater; or travel at 5 miles per hour when the posted speed limit is 20 miles per hour or less, when driving on a two-lane road, except when otherwise directed by a law enforcement officer.
Police Crown Victoria
_________________________________________________________________________________________________________________
A fiery scene on Florida’s Turnpike unfortunately has occurred again and a as result, a Florida Highway Patrol Trooper was killed while sitting in his patrol unit on the side of the roadway.
There are many models of police vehicle(s) that are being used by Police Agencies across the Country, but the Ford Crown Victoria police models account for the vast majority of cases of fatal fires involving rear end collisions.
There are many cases involving rear-end collision where police officer(s) have survived crashes at speeds anywhere from 55-110 M.P.H. on impact.
Throughout the United States Personal Injury Attorney(s) are being hired to represent family member(s) of Law Enforcement Officer(s) injured and or killed as a result of crashes involving Crown Victoria fires.
Every year more and more officer(s) are injured or killed in crashes as a result of driver(s) failing to slow down or move over one lane. Recently, FHP Trooper Patrick Ambroise was struck from behind and killed while sitting inside patrol vehicle on the Florida Turnpike in Miami-Dade County.
The law requires motorists approaching emergency personnel working at the side of the road to either change lanes to create a safe zone for them, or to slow down to 20 m.p.h. below the speed limit until they pass the scene.
Safety-Tips
If you are driving on a two-lane roadway, please slow down to a speed that is 20 miles per hour less than the posted speed limit.
If you are driving on a roadway and at the time the speed limit is 20 miles per hour or less, please slow down to five miles per hour.
If you are driving on an interstate or roadway with multiple lanes and you approach an emergency or law enforcement vehicle on the shoulder, give them room and vacate the lane closest to that vehicle as soon as it is safe to do so.
If for some reason you cannot move over safely, please slow down to a speed of 20 MPH below the posted speed limit unless directed otherwise by a law enforcement officer.
